Terms & Conditions
1. Scope
These Terms & Conditions govern the use of the software platform “Repufiy”, a product of DigitaliX (“Provider”).
Repufiy is a cloud-based software solution for analyzing, managing, and automatically responding to Google reviews via the Google Business Profile API.
2. Subject Matter
The Provider grants the Customer access to the SaaS platform during the term of the agreement.
The software is provided as Software-as-a-Service via the internet. No source code is transferred.
3. Registration & Contract Formation
The agreement is concluded upon registration and acceptance of these Terms.
The Provider may reject registrations without stating reasons.
4. Services
Repufiy provides:
Synchronization of Google reviews
AI-based analysis
Automated response generation
Optional automatic publishing
Dashboard management
No guarantee of business success or specific response quality is given.
5. AI-Generated Content
AI-generated responses are automated outputs.
The Customer remains responsible for reviewing and approving content where auto-publishing is enabled.
The Provider assumes no liability for legal or commercial consequences of generated responses.
6. Availability
The Provider aims for 98% annual availability, excluding maintenance, force majeure, or external disruptions.
7. Customer Obligations
The Customer shall:
Keep credentials secure
Avoid unlawful use
Comply with Google API policies
8. Fees
Paid plans are billed monthly or annually.
The Provider may suspend access in case of payment default.
9. Term & Termination
The agreement runs for the selected subscription period.
Termination is possible at the end of the billing cycle.
10. Liability
Unlimited liability for intent and gross negligence.
Limited liability for slight negligence concerning essential contractual obligations.
No liability for indirect damages or lost profits.
11. Data Protection
Personal data is processed in accordance with the Privacy Policy and Data Processing Agreement (Art. 28 GDPR).
12. Amendments
The Provider may amend these Terms with future effect upon prior notice.
13. Governing Law
German law applies.
Place of jurisdiction is the Provider’s registered office.
